Dear Saints.

I have now found one of the five smooth stones in the brook.
I had an overwhelming response by phone and e-mail from you. Thanks to all of you who sent your help and support and prayed for this matter. The good news is the Judge gave me 2 weeks to find an attorney. My next court date is set for September 25th at 9am. I am praying between now and then that this case will be dropped. Please continue to be in prayer about this matter. I may need some special help from you. I thought we could call and fax the city about this matter at some point. If all of you respond in this way I believe they may be pressured to drop the case. I will keep you all posted in the near future. Please pray also for the right attorney for this case. Not just anyone will do because there is a constitutional issue at hand.

Most of you know that I was recently falsely arrested and jailed for about 6 hours and charged with criminal trespass on public property for preaching the glorious Gospel of our Lord and Saviour Jesus Christ. I now have an ADF attorney who has taken this case. Below is the latest news.

When I showed up at the court there were an army of, "Onward Christians Soldiers," marching as to war. We greatly outnumbered them. There were at least 6 pastors one evangelist, two prison chaplains, several missionaries and church workers and many fellow Christians. All in all there were 20 of us total. What a surprise for me. I cannot thank them enough for taking time out to make a difference! You should have seen the look on the district attorney's face when she saw all us get up to leave and realized they were there on my behalf. We just about empted the court room after we left. I could read her lips as she was counting all of us and I could just about read her mind. She looked like her heart dropped to the floor.
Prier to court, my attorney, tried to reason with her to drop the case stating I was with-in my rights and had not broken the law. My lawyer told me she had no understanding of constitutional law. She decided to continue with the case even after my attorney showed her that the law I was charged with does NOT apply to me at all. They did not give me back my camera so my lawyer submitted a motion for discovery. This will allow us to get a copy of the video. Pray they do not tamper with it! One great thing is there is a new judge residing over this case. A female judge named, Clark that is known for being a fair judge who rules on the law. Wow, isn't that what there're supposed to do? My attorney was very positive about this. So as, Prov. 21:1 says, "The king's heart is in the hand of the LORD, as the rivers of water: he turneth it whithersoever he will." Let's pray God will move on her heart to make a ruling of, not guilty. We still have time before trial and the district attorney can still drop the case. My next court appearance is set for Wednesday, October 11th at 9am. Those that can come are welcome to attend. Mark it down on your calendar. It would be great to fill the court room with as many, "Onward Christians Soldiers," as we can get! We also had a great time of prayer, fellowship, and witnessing going on. It would be best to show up 30 minutes early. We can work out sleeping arrangements if needed. This would be a GREAT home schooling trip. I am not one who asks for this and at first I discouraged those who said they wanted to come because I don't like my brothers and sisters to go out of their way for me, but I must say I know this gave us all a sense of accomplishment for the Church of Jesus Christ that we will never forget.

2 Cor. 1:11 Ye also helping together by prayer for us, that for the gift bestowed upon us by the means of many persons thanks may be given by many on our behalf.
Nothing new has developed. At our next court date it looks like we will submit a request to dismiss. The judge will review the case and it could get dropped before trial. This could be a 50-50 chance,(100% with prayer!)
We have not received any evidence yet. They will likely wait until just before court, (a dirty trick) on their part to give us any evidence (video etc.). There were many who came last time to give their support last time (20 in all) and now even more are planning on coming.
My next appearance will probably be like the last one, short. Therefore, for those who are planning on showing up, it would be best to wait until the trial day; especially for those who live several hours away and who are planning on taking off from work. I would rather have more show up on the trial day, verses now. However, those who live close by are encouraged to come because it will still help to have some appearance there.
My attorney told me that the judge was very impressed last time because the case was important to so many people. You all made an enormous impact for sure! Please continue to pray and I will keep you abreast as this case unfolds.

Today's events in the court are as follows:
About 14 people came to support me, six of which were pastors which was a real blessing. I praise God for their encouragement. Our attorney put in a motion to dismiss the case. The prosecutor said, "We do not have the tape and we are not able to get it." What a joke! She said, "We do not know where it is and the police have it." You mean to tell me that in two weeks she could get a copy of this video? The prosecutor has access to all the evidence from the police, this is another stall tactic. She did admit to my lawyer that I did have a right to be on the College, but I should have left. Well, if I had a right to be on the College why should I have to leave? Anyway, they didn't allow me to leave which is clearly portrayed on in the missing video. This tape will really make them look bad and that is probably why they do not want to show it. For what ever reason they don't want to give back the video tape, so be in prayer about that. They have now postponed it again another two weeks. The date is set for the 25th of October. I will be in Ohio preaching at that time. There is no need for me to be there next time for they are just going to set another date.
It is getting cold up here and we will have some difficulties ahead. One, we do not want our camper's water pipes to freeze like last year. Two, I do not have four-wheel drive and the snow seasons is headed here soon. Three, this ties me up for booking any meetings for deputation which will hurt our support we need to raise, not to mention the love offerings that we use to live on. Four, it's hard to preach and gather a crowd on the colleges in the cold up here. Please keep these matters in prayer and thank you for praying and keeping in touch. I have had so many good responses for al over the country and even overseas. I know the Lord will guide that stone to the giant's forehead before too long.
Some side news in the past few weeks by God's grace, I have gotten three different churches started for a college ministry on three major college/universities near them. On these college/universities we have seen several students make a profession of faith in Christ and had some come to church as well. We have also had several new church make mention of taking us on for support.

We want to send our thanks to so many of you that have been 100% behind us through this whole time. I have never seen so many Baptist Churches pull together like this before. Pastors, evangelists, missionaries along with thousands of faithful Christians across this county have been very supportive of us. I still am in shock over the great responses and offers to help. I never realized just how many people were and are behind our ministry before. I can't help but get emotional as I right this letter. I feel so humbled that so many have and are stepping up to help us. There is no doubt in my mind that God is getting the praise and glory and honor due to His name through this whole ordeal. I have been getting some great coverage in the paper as well. Yesterday's front page paper of the Ulster Times said, "College campus preacher wins another round." Wow, what a blessing. So far every time the papers have mentioned about my banners that say, "Jesus is Lord and "Read the Bible." To God be the Glory! I know He is pleased that His church is showing forth its charity. I can't help but think about what Paul the apostles said in 2Tim 4:16 "At my first answer no man stood with me, but all men forsook me: I pray God that it may not be laid to their charge." Paul didn't want God to lay it to their charge. No doubt when we forsake a brother who is standing for the truth's sake God is displeased and will hold those who forsook the brethren accountable. It can be easy to say when we are not in the trial seat, "Well I would have done this or that" but we must stand in support and pray for our brother or sister. This you have well done. If there be some who haven't, I pray that I can say with Brother Paul, "I pray God that it may not be laid to their charge." Thank you again.
Now here is what has happened lately. I had my dates mixed up and court was on Tuesday the 14 th. My attorney called me and said he got a continuance for the next day. However, the prosecution still did not provide a copy of my tape. He asked the Judge to tell them to do so, to which he did. This is about the fifth time unfortunately. My attorney said I would be there tomorrow with the equipment to do so. Wednesday I pled not guilty to the new charges. They said they could not copy the tape that day but for me to come back tomorrow (a four hour round trip drive from where we are parked) to try it.
I spoke to the Deputy County Attorney, Fred L. Goodman who wanted an extension to respond to what I filed in federal court. By the way, he had on his extension December 31 st which another brother pointed out to me that the 31st was a Sunday. They were tricky but the Lord was looking out for me and I gave them only a week more. Before I gave him and extension I asked him about getting my video he said he was going to get me a copy. I signed the extension but he said he wasn't able to get the video. Sooooooo. I filed a MOTION TO EXECUTE WARRANT. If signed, the Judge will get the US Marshall to get me a copy. I also filed a MOTION FOR SANCTIONS which will fine them because they are in contempt of a federal court order. I also asked for an extension to file my brief on why Americans should be allowed to use video cameras in public places like colleges. Pray that God will move on the heart of the Judge to do all this and more. That's the big prayer for now!
I had a great time at SCCC the other day. I met one student who I really was able to share a lot of Bible with. I think he was close to trusting Christ. His name slips me at the moment but God knoweth. One student said, "I'm an atheist!" I told him, and the other student next to him, "I do not believe in atheists, there is no such thing as an atheist, they do not exist" I asked him if he knew everything, He replied, "no" neither do you." I said, "No I don't" Then I told him since he doesn't know everything there could be proof for the existence of God. He agreed and you could tell that he never thought about it like that before. Please pray for this student's salvation.
My next court date will be November 29th where we'll be submitting motions. They will most like schedule a trial date then.

Dear Saints,
As I sat in court with Amy this morning I did not see my lawyer. After calling his office I found out my attorney forgot we had court today. So now it got moved to this Friday at 9am. The good news is they have conceded to the fact that I had a right to be there and will drop that part of the charge. The bad news is now they are going to lie and say before I was running the camera, which was before they approached me, that I was harassing students or something to that affect. This is not true of course; I wasn't even set up yet before they came out to me.
The other good news is I received a copy of my video take. Amen! After viewing the tape it is clear this will not help but rather hurt them. This is why they need to say before I began taping I was a mad man.
They will set a trial date on Friday and I will let you all know.

Dear Saints,
I wish you all could have been there to see the prosecutor just hem and haw at the judge. He told the Judge that they were not going to argue that I was trespassing. He told the judge he was going to write some thing up (which means make something up) for he did not have anything typed out yet but he would submit it when he had it done. Sooooo what did I do? Good question. They do not have anything yet. They are going to say I was harassing some of the students before I turned on the camera according to my attorney. So why didn't they charge me with harassment? Or disturbing the peace? Because they didn't think I really was allowed there but now they have seen the errors of their ways but they are too proud to admit it. If they drop everything they open themselves to a big law suit. If they let it go to court they can say that the witnesses never showed up and that's why I got off. They did tell my attorney they are not seeking any jail time. My lawyer said they just want a way out without them looking bad. Now my crime is put down to a lesser penalty of 15 days in jail and a small fine. Remember that at the first it was a year in jail then 3 months and now 15 days. They cannot go any lower. The judge also released the bail.
January 18th 2007 at 1:30pm is my trial date. Many churches have said they would come. The Judge did make it for a Wednesday but because of church I had it moved to Thursday the 18 th. The more that show up the better. I will send out the details as we get near the date. I pray this will give you enough time for those who said that you would take off from work to come. I am so blessed that so many of you would sacrifice a day off for us and I know the Lord will bless you more than you could expect. I have some strategy in mind that should go over very well. Those that are planning to attend please e-mail me so I can get a ruff count. Pastors that will be bringing groups in a van, just get a head count for me. My number is 845 657-3030.
I will be planning on giving my civil case over to an attorney soon. I learned a lot but I can't spend the time on it I would rather be preaching.
I'll be heading south for a few weeks. I am planning on hitting the southern state colleges and universities. Pray my truck holds up because it is just about shot and I had trouble yesterday with it. My transmission and engine are on its way out. I will be looking for another truck during my trip. I cannot wait any longer so please pray I find a good deal. I may just get a motor home but I'm not sure yet what I will do.
Amy is 6 months today and she is doing fine. I had a great time preaching in a church today in PA. God bless you all.
Davis vs Goliath First Trial Court Appearance

I'm very tired so here's the short of it. Just before 1:30 I got a call from my mom who was outside the court house. My dad who is almost 82yrs old fell and hit his head on the sidewalk cut his head open cut his hand open and was taken to the hospital in an ambulance. He got stitches and is OK now but is really sore, please pray for him.
When we told the Court the other day we would be bringing a stenographer they said they would get one for us and not to worry. After I arrived at court my attorney told me that the stenographer the court said would be there, came in said he didn't feel good and left. That way it eliminates a court of recorded for an appeal. How convenient and tricky. What they did not know is we had a backup one just incase. Thanks to pastor John Koletas who showed up, who is a full-time stenographer? He set up and then after about 20mins they let him go and said they found another on to come in, again how convenient and tricky.
Two witnesses took the stand. The first witness was a woman who is a student about 40-45 yrs old, said my speech was "hate speech" and that I was condemning homosexually. She lied in her testimony and that was clear by my video that was showed. She showed up with a woman friend. The second witness that showed up was the dean of adim. who had me arrested. He testified that he lives with his "partner". Is the picture coming together now? He lied so much that his testimony may be thrown out for impeachment.
We went to about 5:45pm and stopped. Tomorrow around 2pm the police officers will be called in and I will testify after them. So far it is looking really good. However, this Judge works for the city and I have a law-suit against them. So keep on your knees.
So much thanks goes out to everyone who helped and the about 40 Christians some who drove many hours to support us. I can't thank them enough so I'll have to take all eternity to do it.

I guess not everyone got this or I sent Thursdays by accident because I was so tired. Thank you everyone for praying and the e-mails of over whelming support. Here's what happened Friday:
I'm very tired again and not much happened. It was supposed to start at 2:00PM and it started at 3:45PM. One officer was called to the stand. He testified that I was "peaceable," and that I did "not" resist arrest. He then said I refused to leave and then when my attorney asked him if I every refused to leave he said that I did not refuse to leave. What a mess.
The state rested its case.
Monday 2:00PM is when I TAKE THE STAND.

Good very early morning. Here is a copy of what was released to me of the day I was arrested.
(Davis Video) You will notice the dean acting very unprofessional sarcastic. etc and stating the college was private though he testified it was public. You will see the police ask me if I would leave and that I very clearly said yes, though I by law did not have to leave and that I asked his permission to speak to him and he said "yes". You will also see the office had me detained and was holding my drivers license so I couldn't have left. The best part is the gospel is all through it and everyone at court is hearing it over and over. Any comments you have that I can use as arguments are welcomed.

Please allow me to keep this brief for I am tired again. I plan on filling you in on the detail at a later date. I took the stand and my attorney said the prosecutor with her gloves on didn't even touch me. It will be a few weeks before the Judge makes his decision so for now we can pray, pray, pray! I thought I would have had the judge's decision by now but we are still waiting. I did get a call from my attorneys yesterday and now I think I know why there has not been a decision yet. They said they are willing to drop the charges if I settle out. In other words the judge seems to be stalling in hopes I will settle out before he makes his decision which will be to their advantage. They wanted me to hurry up and give them all the costs I have incurred so far. They also said that my 9 hrs in jail would not be worth much, maybe a few hundred dollars. I asked why they didn't offer to drop the charge before they put me, my family and friends through this whole mess and wasted the tax payers money prosecuting an innocent man. They are not willing to apologize either. No repentance! So they pressured me for a date as to how soon I could get a figure to them. I said, "I'll probably have a figure for you right after the judge makes his decision ." Keep praying.
Amy and I had a good time at a local college today even though there were not many students around. Fridays are dead days sometimes. Pray for this one student named, "John" he said he was saved but didn't have a really clear testimony.
